AND IN THE MATTER OF RIDEAU CARLETON RACEWAY
RULING
A hearing was convened at the request of the Administration with respect to Rideau Carleton Raceway’s failure to comply with Ruling GEN11/2000 of October 5, 2000.
On April 12, 2001 Chair Stanley Sadinsky, Q.C. and Commissioners Thomas Deacon, Dr. Bruce Duncan, Ernest Nock and Diane Carlton of the Ontario Racing Commission (ORC) convened to hear the matter.
Counsel Robert Lewis appeared on behalf of Rideau Carleton Raceway and Counsel Don Bourgeois appeared for the Administration.
On reading the exhibits filed and on hearing the submissions of the parties, the Commission made the following order:
The race dates scheduled for December 24 to 31, 2001 are hereby cancelled.
Rideau Carleton Raceway shall follow through with its commitment to expend $100,000 towards a marketing campaign directed towards the “reopening” of the racetrack when the new lighting is in place.
Rideau Carleton Raceway shall negotiate with representatives of the Ontario Harness Horse Association and the Administration with respect to the most effective use for the additional $30,000 commitment made by Rideau Carleton Raceway. In the absence of an agreement acceptable to the Administration, the Administration shall refer this matter back to the Commission for a decision on the most effective use of this $30,000.
Rideau Carleton Raceway shall complete the installation of the lighting improvements no later than June 30, 2001. The Commission understands that Rideau Carleton Raceway anticipates that the installation shall be completed by the first week of June, 2001. Should any further delay be encountered, the Administration shall immediately refer this matter back to the Commission.
Should any matter need to be referred back to the Commission or if any further rulings from the Commission are required, a differently constituted panel of the Commission may be convened. This panel is not seized with the matter.
This hearing is adjourned sine die.
