RULING
Jockey Emile Ramsammy appealed the decision of the Ontario Thoroughbred Racing Industry Appeal Board dated August 2, 2001, wherein the panel upheld TB Ruling 2001-222. Pursuant to Ruling 2001-222, Emile Ramsammy was suspended for three racing days, July 11, 12, and 13, 2001, for striking his mount "MUHAYAA'S CROWN" on the head during the stretch run of the 5th race on July 2, 2001, at Woodbine Racetrack in contravention of TB Rule 9.27(d)(i) and (f).
On October 17, 2001, ORC Vice Chair Herbert Bryant convened to hear the appeal along with Commissioners Dr. Bruce Duncan and Ernest Nock.
Counsel Shale Wagman appeared on behalf of Mr. Ramsammy and Counsel Joanne Mitchell appeared for the Administration.
On hearing the evidence of ORC Steward Richard Grubb and Emile Ramsammy, on reviewing the videotape evidence presented, on reading the exhibits filed and on hearing the submissions of the parties, the panel dismissed the appeal.
On agreement between the parties, Mr. Ramsammy will serve his 3-day suspension on October 31 and November 1-2, 2001.
