COMMISSION HEARING TORONTO, ONTARIO – August 16, 2000
IN THE MATTER OF THE RACING COMMISSION ACT, R.S.O. 1990, c. R2;
AND IN THE MATTER OF A HEARING INTO TELETHEATRE OPERATIONS:
Correspondence was received from The Ontario Jockey Club requesting a second hearing on an application for a teletheatre licence for a site located at 144 Main Street North in Markham, to be known as Heritage Champions.
Chair Stanley Sadinsky, Q.C. and Commissioners Patricia Bullock, Diane Carlton, Bruce Duncan and Ernest Nock convened to hear the application. Commission Counsel Joanne Mitchell, and Wendy Hoogeveen appeared for the Administration.
Parties to the hearing included The Ontario Jockey Club, represented by Brian Brett, and Town Solicitor Robert Robinson representing the Town of Markham.
Upon hearing the representations of Mr. Brett and Mr. Robinson, upon reviewing the exhibits filed, and upon hearing the submissions on behalf of the parties, the Ontario Racing Commission approved the application subject to the following conditions:
the Administration of the ORC be satisfied that the process of applying for a liquor licence was underway. Failure to obtain a liquor licence within 120 days of this Ruling may trigger a review of the teletheatre licence;
as consented to by both parties, the hours of operation for the teletheatre portion of the establishment would be 11:00 a.m. to 12:00 midnight. In the case of special events, the licensee may apply to the municipality for an exemption; and
at no time in the future would VLT’s or slot machines or other similar gaming machines be permitted on the premises.
As is Commission policy regarding all teletheatre licences, any party to these proceedings may apply to the Ontario Racing Commission to review the teletheatre licence and the Commission will convene a hearing to review the concerns where it is determined cause is warranted.
Reasons for decision were given verbally at the hearing and form part of the transcript.
