COMMISSION HEARING TORONTO, ONTARIO – October 5, 2000

AND IN THE MATTER OF A SHOW CAUSE HEARING FOR
RIDEAU CARLETON RACEWAY HOLDINGS
RULING
A hearing was convened at which Rideau Carleton Raceway was required to show cause why its licence to operate a race track should not be suspended, cancelled or revoked until such time as the lighting system has been upgraded to a standard acceptable to the Administration of the Ontario Racing Commission and the Canadian Pari-Mutuel Agency.
On October 5, 2000 Chair Stanley Sadinsky Q.C., Vice Chair Herbert Bryant and Commissioners Patricia Bullock, Diane Carlton, Thomas Deacon, Dr. Bruce Duncan and Ernest Nock of the Ontario Racing Commission (ORC) convened to hear the matter.
Counsel Robert Lewis appeared on behalf of Rideau Carleton Raceway, Reed Lawson appeared on behalf of the Ontario Harness Horse Association, Robert McReavy appeared on behalf of the Canadian Pari-Mutuel Agency (CPMA), Jane Holmes appeared on behalf of the Ontario Horse Racing Industry Association and Counsel Ann Gibson appeared for the Administration.
On reading the exhibits filed and on hearing the submissions of the parties, the Commission
made the following order:
Rideau Carleton is required to:
Ensure all malfunctioning bulbs are replaced every racing night, prior to racing, while the system is activated.
Install five (5) additional poles with multiple heads (approximately 30 new lights) in the north turn by October 16, 2000.
Install additional photo finish lighting at the finish line in consultation with the Canadian Pari-Mutuel Agency by October 23, 2000.
Report back in writing to the ORC and CPMA on the status of the above changes by October 25, 2000.
Report back in writing to the ORC and the CPMA on the status of the long term solution by October 25, 2000.

Report back to ORC and CPMA with a concrete proposal for a new lighting system by December 1, 2000. This report is to include a construction schedule with a completion date on or before the 31st of January, 2001 and is to be supported by the opinions of Rideau Carleton experts and the CPMA as to the viability of all alternative proposals.
Keep the Administration of the Ontario Racing Commission apprised of all developments. The Administration shall have the authority to make any changes to the schedule and, as always, it is open to the Administration to bring the matter back before the Commission if it sees fit. The full panel of the Commission is not seized of this matter for future reviews or reconsiderations.
The Commission gave oral reasons for its decision which form part of the transcript.
