COMMISSION HEARING TORONTO, ONTARIO – January 21, 2000
IN THE MATTER OF THE RACING COMMISSION ACT, R.S.O. 1990, c. R2;
AND IN THE MATTER OF A HEARING INTO TELETHEATRE OPERATIONS:
An application for a teletheatre licence to be located at 144 Main Street North in Markham to be known as Heritage Champions, was received from The Ontario Jockey Club. While considered incomplete by the Administration for lack of correspondence from the local municipality stating they had no objections to the site, a hearing was scheduled to review the merits of the application.
Chair Stanley Sadinsky, Q.C. and Commissioners Diane Carlton, Thomas Deacon and Bruce Duncan convened to hear the application. Commission Counsel Ann Gibson, and Wendy Hoogeveen appeared for the Administration.
Parties to the hearing included The Ontario Jockey Club, represented by David Gorman, the site operator represented by Counsel Robert Doumani and business operators Marty Toombs and Leslie Patterson, and Town Solicitor Robert Robinson representing the Town of Markham.
Upon hearing the representations of Marty Toombs, Leslie Patterson, David Black, June Williamson, Pat Perini, Ray Bushell, Lou Barasso, George Rifferit, Chris Boudakian, upon reviewing the exhibits filed, and upon hearing the submissions on behalf of the parties, the Ontario Racing Commission denied the application without prejudice, inviting the applicant to re-submit the application when it is complete. Reasons for decision were given verbally at the hearing.
