REASONS FOR DISPOSITION

Introduction
On December 4, 2019, Mr. Jachja Al-Masajidi, was found not criminally responsible on account of mental disorder on charges of unlawful possession of a firearm, carrying a concealed weapon, possession of a firearm contrary to the Court Order, and failure to comply with a probation order, all contrary to the Criminal Code.
Mr. Al-Masajidi is currently subject to a disposition of the Ontario Review Board dated October 2nd, 2024, which detains him at the Secure Forensic Unit of the Royal Ottawa Mental Health Centre (“ROMHC”) with privileges allowing him to live in the community in not less than 8-hour a day supervised accommodation approved by the person in charge.
On October 21, 2025, a panel of the Board convened a hearing at the ROMHC to conduct Mr. Al-Masajidi’s annual review hearing pursuant to section 672.81(1) of the Criminal Code. Mr. Masajidi was present and represented by counsel Ms. Garcia.
The issues to be determined at the hearing were whether Mr. Masajidi continues to represent a significant threat to the safety of the public as defined in section 672.5401 of the Criminal Code and, if so, what is the necessary and appropriate disposition which is also the least onerous and least restrictive taking into account the factors set out in section 672.54 of the Criminal Code.
Position of the Parties
At the outset of the hearing, the Hospital, counsel for the Attorney General, and counsel for Mr. Al-Masajidi, all indicated that they agreed with the continuation of the current disposition, with minor variations in the wording of specific terms, namely those related to travel.
At the conclusion of the hearing, all parties confirmed their joint submission: that Mr. Al-Masajidi continues to pose a significant threat to the public, and the necessary and appropriate disposition was a continuation of the existing detention order with some minor changes to his travel conditions and to the condition that he be permitted to reside in the community in accommodations approved by the person in charge.
