REASONS FOR DISPOSITION

Introduction
On November 28, 2011, the accused, Aaron Maki, was found not criminally responsible on account of mental disorder on three charges of assaulting police, contrary to the Criminal Code of Canada. He is currently subject to a Disposition of the Ontario Review Board dated June 18, 2025, ordering that he be detained at the Forensic Program of Ontario Shores Centre for Mental Health Sciences (“Ontario Shores”, or the “hospital”) with privileges up to living in the community in accommodation approved by the person in charge.
On May 11, 2026, the Ontario Review Board (the “Board”) convened at Ontario Shores to conduct Mr. Maki’s annual review and to make a Disposition, pursuant to s. 672.81(1) of the Criminal Code. Mr. Maki was present and represented by his counsel, Mr. McIver. Ms. MacDonald appeared on behalf of the Attorney General of Ontario. Dr. Pytyck appeared on behalf of the hospital.
The issues for the hearing were whether Mr. Maki continues to meet the threshold of significant threat to the safety of the public and, if so, to determine the Disposition that is necessary and appropriate in the circumstances.
For the reasons set out below, the Board finds that Mr. Maki continues to pose a significant threat to the safety of the public and that the necessary and appropriate Disposition is a Detention Order Disposition with the same terms and conditions as in Mr. Maki’s previous Disposition, with the addition of two provisions: i) that Mr. Maki be permitted to travel within Southern Ontario for up to 7 days, subject to the approval of his itinerary by the person in charge; and ii) that Mr. Maki have indirectly supervised access to the community of Ontario within 150 kilometres of the hospital.
