REASONS FOR DISPOSITION

Introduction
On January 5, 2026, Alda Kang was found unfit to stand trial on charges of assault (x3), obstruction of a police officer (x2) and assault of a police officer, contrary to the Criminal Code of Canada (the “Criminal Code”). Ms. Kang was remanded to the jurisdiction of the Ontario Review Board (the “Board”) with a Warrant of Committal to be detained at the Centre for Addiction and Mental Health (“CAMH” and the “Hospital”).
On April 16, 2026, the Board convened at CAMH to conduct a hearing pursuant to s. 672.47(1) and 672.48(1) of the Criminal Code to determine Ms. Kang's fitness to stand trial and to make a disposition, if necessary. Ms. Kang attended her hearing and was represented by counsel, Mr. A Stastny.
Dr. C. Kung presented on behalf of the Hospital and submitted that Ms. Kang is fit to stand trial and should be remanded back to the court for the adjudication of the issue of fitness. Counsel for the Attorney General agreed with the Hospital’s position. Mr. Stastny joined the submission of the Hospital and so it was a joint submission that Ms. Kang was fit to stand trial.
For the following reasons, the Board finds that Ms. Kang is fit to stand trial.
