REASONS FOR DISPOSITION

On September 27, 2022, Terrell Sullivan was found not criminally responsible on charges of failure to comply with release order, theft under $5000, mischief under $5000 and robbery while armed, all contrary to the Criminal Code of Canada (“the Criminal Code”).
Mr. Sullivan is currently subject to a Disposition of the Ontario Review Board (“the Board”), dated March 24, 2025, detaining him at the Southwest Centre for Forensic Mental Health Care (“the Hospital”) subject to a number of conditions and an envelope of privileges the most liberal of which includes to live in the community of Elgin and Middlesex County in accommodation approved by the person in charge.
On July 24, 2025, staff observed Mr. Sullivan receiving a package thrown over the main courtyard fence. The package contained psilocybin (“magic mushrooms”) and two vaping devices. Mr. Sullivan’s privileges were revoked. By way of letter dated August 22, 2025, the Board was notified of the increase in the restrictions on Mr. Sullivan’s liberty. Periodically over the next several months, Mr. Sullivan’s privilege level fluctuated, with frequent variations in his liberties, in response to testing positive for amphetamines on several occasions in August and November 2025, eloping from the Hospital during a staff-accompanied outing on October 9, 2025, attempting to exchange items with co-patients from their balconies and defiance of staff. Brief periods of seclusion were occasionally necessary to manage his behaviour. A Restriction of Liberty (ROL) hearing was held on December 8, 2025. In its decision dated December 17, 2025, the Board found that the various restrictions in Mr. Sullvan’s liberty commencing July 24, 2025 and thereafter, were necessary and appropriate and represented the least onerous and least restrictive measure at the time it/they were imposed and continued to be so up to the date of the hearing.
