REASONS FOR DISPOSITION

Introduction
On February 19, 2019, Andrew Greszczyszyn was found not criminally responsible on account of mental disorder on charges of repeatedly communicating directly or indirectly with a person, criminal harassment (x2), and failing to comply with an undertaking (x2), contrary to the Criminal Code of Canada. Dr. Greszczyszyn is currently subject to a disposition of the Ontario Review Board (ORB/the Board) dated March 29, 2025, detaining him at the General Forensic Service of Ontario Shores Centre for Mental Health Sciences (Ontario Shores/the hospital) with discretionary privileges up to and including the ability to reside in the community in approved accommodations.
On March 18, 206, the Board convened a panel to conduct the annual review of Dr. Greszczyszyn’s disposition pursuant to s. 672.81(1) of the Criminal Code. Dr. Greszczyszyn was present and chose to represent himself. Ms. Francis, attending by zoom technology, appeared as amicus curiae.
At the outset of the proceedings, the parties were canvassed as to their positions on the issues to be determined by the Board: whether Dr. Greszczyszyn remains a significant threat to the safety of the public, and if so, the necessary and appropriate disposition having regard to the criteria in s. 672.54 of the Criminal Code.
Ms. Szabo, on behalf of the hospital, submitted that Dr. Greszczyszyn remains a significant threat to the safety of the public and the necessary and appropriate disposition is a discharge with conditions including that he continue to reside at his current address, he consent to take medication as directed and refrain from contacting the victims. Mr. Hewitt, on behalf of the Attorney General, reserved taking a position until the conclusion of the evidence. He ultimately agreed with the hospital’s position. Dr. Greszczyszyn indicated that he did not represent a significant threat to the safety of the public and therefore was entitled to an absolute discharge.
Findings
- For the reasons that follow, the panel found that Dr. Greszczyszyn remains a significant threat to the safety of the public and the necessary and appropriate disposition is a conditional discharge.
