REASONS FOR DISPOSITION

Introduction
1On December 1, 2017, Trevaun Brown, was found not criminally responsible on account of mental disorder (“NCR”) on charges of utter a threat to cause death or bodily harm (x2), contrary to the Criminal Code of Canada.
2Mr. Brown is currently subject to a disposition of the Ontario Review Board (“ORB” or “the Board”) dated June 2, 2025, which detains him at the Forensic Psychiatry Program of St. Joseph's Healthcare Hamilton, West 5th Campus, on terms and conditions including to enter the community of Hamilton accompanied by staff or a person approved by the person in charge.
3By way of letter dated February 3, 2026, St. Joseph's Healthcare Hamilton, hereinafter referred to as the hospital, wrote to the Board requesting an early hearing to review Mr. Brown’s last disposition and seeking a transfer to the Waypoint Centre for Mental Health Care – High Secure Provincial Forensic Programs – Penetanguishene (“Waypoint”) due to a number of serious incidents leading the hospital to conclude that it could no longer safely manager Mr. Brown’s care at its facility.
4On March 12, 2026, the Ontario Review Board convened a hearing which took place virtually by Zoom, to hold an early review of Mr. Brown’s disposition pursuant to s. 672.81(2) of the Criminal Code. Mr. Brown was present for the hearing, represented by counsel, Ms. C. Francis. A Hospital Report dated February 19, 2026, was entered as Exhibit 1 for the hearing.
5Mr. Brown attended the hearing from the Hamilton Wentworth Detention Centre where he has been held following a charge of Assault Causing Bodily Harm arising from a serious assault on staff allegedly having taken place January 31, 2026.
