REASONS FOR DISPOSITION

Introduction:
1On February 18, 2026, Denys Borysiuk was found unfit to stand trial on charges of resist or obstruct public or peace officer, and theft not exceeding $5,000, contrary to the Criminal Code. The court referred the matter to the Ontario Review Board (“ORB” or the “Board”) for a disposition hearing.
2On April 1, 2026, a panel of the Board convened at the Waypoint Centre for Mental Health Care (“Waypoint” or the “hospital”) to review Mr. Borysiuk’s fitness to stand trial and to make an initial Disposition pursuant to sections 672.47(1) and 672.48(1) of the Criminal Code.
3Mr. Borysiuk did not attend the hearing. Ms. Beaubien stated that she attempted to meet with Mr. Borysiuk virtually last week with the assistance of a nurse, but he did not wish to engage or say anything to her. Dr. Van Impe stated that he attempted to speak with Mr. Borysiuk in advance of the hearing today, and Mr. Borysiuk covered his face and body with his blanket and did not engage with him at all. However, Dr. Van Impe reported that the team leader had asked Mr. Borysiuk very specific yes/no questions to which he responded. When asked if he wanted to attend the hearing he responded “no.” When asked if he was willing to speak with his lawyer he said “no.”
