REASONS FOR DISPOSITION

Introduction:
1On May 30th, 2025, the accused, U (M.D.), was found not criminally responsible on account of mental disorder on charges of forcible confinement (x2), Dangerous driving assault causing bodily harm (x2), sexual assault (x2) and possession of a weapon or imitation, all contrary to the Criminal Code of Canada (“Criminal Code”). At the time of the finding of not criminally responsible, the Honourable Court did not make a Disposition and referred the matter to the Ontario Review Board.
2On August 21st, 2025, the Ontario Review Board convened a hearing at the Royal Ottawa Mental Health Centre, hereinafter referred to as the hospital, to hold U (M.D.)’s initial hearing pursuant to s. 672.47(1) of the Criminal Code. U (M.D.) was present for the hearing and was represented by his counsel, Mr. Biagio Del Greco. Also in attendance was Case Manager, Mr. Steve Su, and Social Worker, Mr. Jean-Michel Frechette.

4Dr. Bourget indicated that the hospital recommendation was a detention order with the most liberal privilege being to reside in the community in approved accommodation. Also to be included was a reporting requirement of not less than once a month. Ms. Dufort indicated that she was ad idem with the detention disposition recommendation with the addition of a non-publication ban of the victims’ names as well as a no contact provision with the victims, including their places of residence and that they only be identified by their initials. She also requested a firearms prohibition.
5Mr. Del Greco agreed with both the hospital recommendations as well as those put forward by Ms. Dufort. The hearing therefore proceeded by way of a joint position.

6The nature of the allegations giving rise to the above charges is summarized in the Crown Brief Synopsis follows:
“On the 14th of February 2025, the accused entered the elevator on the ground level along with victim S. (K.) As she attempted to exit the elevator on the 7th floor, the accused prevented her from leaving by placing himself in front of the doors and grabbed her and attempted to kiss her. She pushed through past him and quickly went to her apartment for safety.
Another tenant complained to the building superintendent that the accused followed his wife back to their apartment at approx 3:04pm. This female does not wish to come forward.
At 4:00pm the accused entered the elevator with victim B. (T.) on the ground level. He attempted to engage in small talk. As she tried to exit the elevator on the 5th floor the accused grabbed her and tried to kiss her on the lips but missed and kissed her on the left cheek/jaw area. He grabbed her and stood in front of her preventing her from exiting the elevator. She eventually pushed
