IN THE MATTER OF the accused Stewart Hunt (DOB: 11.06.76)
AND IN THE MATTER OF a hearing held pursuant to section 672.81(1) of the Criminal Code;
DISPOSITION
(Dated March 14, 2025)
WHEREAS the accused was, on December 15, 2020, found not criminally responsible on account of mental disorder on charges of criminal harassment (x2), and failing to comply with a probation order (x4), all contrary to the Criminal Code;
AND WHEREAS the accused was, on August 16, 2021, found not criminally responsible on account of mental disorder on charges of repeatedly communicating directly or indirectly with person (x2), failure to comply with probation order (x4) and disobeying a court order (x2), all contrary to the Criminal Code;
AND WHEREAS the accused is currently detained at the Waypoint Centre for Mental Health Care – High Secure Provincial Forensic Programs, Penetanguishene;
AND WHEREAS the Ontario Review Board held a hearing at the Waypoint Centre for Mental Health Care on February 27, 2025, to review its current disposition:
IT IS ORDERED that the accused be detained at the Forensic Psychiatry Program – St. Joseph’s Healthcare Hamilton, West 5th Campus, forthwith.
IT IS FURTHER ORDERED that the person in charge of the St. Joseph’s Healthcare Hamilton, West 5th Campus create a program for the detention in custody and rehabilitation of the accused within the Forensic Psychiatry Program – St. Joseph’s Healthcare Hamilton, West 5th Campus, in which the person in charge, in his or her discretion, may permit the accused:
(a) to attend within or outside of the hospital for necessary medical, dental, legal or compassionate purposes;
(b) hospital and grounds privileges, escorted by staff;
(c) hospital and grounds privileges, accompanied by staff;
(d) hospital and grounds privileges, indirectly supervised;
(e) to enter the community of Hamilton, escorted by staff; and
(f) to enter the community of Hamilton, accompanied by staff, or a person approved by the person in charge.
- AND IT IS FURTHER ORDERED that the person in charge of the St. Joseph’s Healthcare Hamilton, West 5th Campus:
(a) notify the local police at such times as he or she exercises his or her discretion to permit the accused to enter the community and to advise the local police of the terms and conditions under which he or she permitted the accused to do so pursuant to term 2 of this Disposition; and
(b) require the accused to submit, on a random basis, samples of his urine and/or breath for the purpose of analyzing whether the accused has ingested alcohol, drugs or any other intoxicant.
- AND IT IS FURTHER ORDERED that the accused, Stewart Hunt:
(a) abstain absolutely from the non-medical use of alcohol or drugs or any other intoxicant;
(b) submit samples of his urine and/or breath to the person in charge of the St. Joseph’s Healthcare Hamilton, West 5th Campus, or his or her designate for the purpose of analyzing whether the accused has ingested alcohol, drugs or any other intoxicant;
(c) refrain from having in his possession any firearm, ammunition or other offensive weapon, or being in the company of any person possessing a firearm other than a peace officer; and
(d) refrain from contact or communication, direct or indirect, with Andrea Romanos.
- IT IS FURTHER ORDERED that until such time as he is detained at the Secure Forensic Unit of the St. Joseph’s Healthcare Hamilton, West 5th Campus, the person in charge of the Waypoint Centre for Mental Health Care create a program for the detention in custody and rehabilitation of the accused within the Waypoint Centre for Mental Health Care, in which the person in charge, in his or her discretion, may permit the accused:
(a) to attend within or outside of the hospital for necessary medical, dental, legal or compassionate purposes; and
(b) grounds privileges beyond the secure perimeter escorted by staff.
- AND IT IS FURTHER ORDERED that the person in charge of the Waypoint Centre for Mental Health Care:
(a) notify the local police at such times as he or she exercises his or her discretion to permit the accused to enter the community and to advise the local police of the terms and conditions under which he or she permitted the accused to do so pursuant to term 5 of this Disposition; and
(b) require the accused to submit, on a random basis, samples of his urine and/or breath for the purpose of analyzing whether the accused has ingested alcohol, drugs or any other intoxicant.
- AND IT IS FURTHER ORDERED that the accused, Stewart Hunt:
(a) abstain absolutely from the non-medical use of alcohol or drugs or any other intoxicant;
(b) submit samples of his urine and/or breath to the person in charge of the Waypoint Centre for Mental Health Care, or his or her designate for the purpose of analyzing whether the accused has ingested alcohol, drugs or any other intoxicant;
(c) refrain from having in his possession any firearm, ammunition or other offensive weapon, or being in the company of any person possessing a firearm other than a peace officer; and
(d) refrain from contact or communication, direct or indirect, with Andrea Romanos.
- AND IT IS FURTHER ORDERED that this Disposition will remain operative until a new Disposition of the Ontario Review Board is issued.
THIS IS THEREFORE TO COMMAND YOU, the person in charge of the St. Joseph’s Healthcare Hamilton, West 5th Campus, and the person in charge of the Waypoint Centre for Mental Health Care, in His Majesty the King's name, to execute the terms of this Disposition.
