REASONS FOR DISPOSITION

Introduction:
On October 19, 2023, Mr. Salim Mohamad was found not criminally responsible on account of mental disorder (“NCR”), on a charge of assault, contrary to s. 266 of the Criminal Code of Canada (“Criminal Code”). Pursuant to a Disposition of the Ontario Review Board (“ORB” or the “Board”) dated February 20, 2024, Mr. Mohamad was found to represent a significant threat to the safety of the public and was ordered detained at the Forensic Service of the Centre for Addiction and Mental Health (“CAMH” or the “hospital”) subject to variety of terms and conditions including the discretionary privilege of living in the community of the Greater Toronto Area in accommodation approved by the person in charge of the hospital.
On February 1, 2021 Mr. Mohamad was criminally charged in connection with an assault on his cousin, Mr. Omran Fares. Pursuant to the terms of a Release Order, Mr. Mohamad was required to reside with his parents in Mississauga under house arrest. On January 24, 2025, Mr. Mohamad was convicted on a charge of aggravated assault, resulting in him becoming a dual status offender. He was sentenced to a term of incarceration (2 years less a day) and remanded to the Maplehurst Correctional Facility “Maplehurst”). The sentencing judge recommended in the Reasons for Sentence that Mr. Mohamad serve his sentence at the St. Lawrence Valley Correctional and Treatment Centre (“St. Lawrence”), but to date, he remains incarcerated at Maplehurst.
The Prehearing Conference Reports that proceeded this ORB hearing indicate that despite notice being provided to Provincial Corrections and several attempts to engage them in this matter, there was no response from Provincial Corrections. All parties indicated they were content to proceed in this matter without Provincial Corrections attendance or involvement, and on the basis that this was solely an annual review hearing.
On September 8, 2025, a panel of the ORB convened a hearing at CAMH to make a Disposition as required pursuant to s. 672.81(1) of the Criminal Code. The issues to be decided at this hearing are whether Mr. Mohamad meets the test of posing a significant threat to
