REASONS FOR DISPOSITION (Dated October 8, 2025)
Introduction
On April 23, 2024, Anatoliy Korzun was found not criminally responsible on account of mental disorder (NCR) on charges of utter a threat to cause death or bodily harm, assault with a weapon, and fail to comply with a release order, contrary to the Criminal Code. He is currently subject to a disposition of the Ontario Review Board (the Board) dated August 16, 2024, ordering that his detention at the Forensic Service of the Centre for Addiction and Mental Health (CAMH) with privileges up to and including entering the community indirectly supervised.
On Thursday August 28, 2025, the Board convened a hearing at CAMH to review Mr. Korzun’s disposition pursuant to section 672.81(1) of the Criminal Code. Mr. Korzun was present at the hearing along with a Russian interpreter and was represented by counsel, Ms. Levin.
The issues to be determined at the hearing were whether Mr. Korzun continues to represent a significant threat to the safety of the public as defined in section 672.5401 of the Criminal Code and, if so, to determine what was the necessary and appropriate disposition that was also the least onerous and least restrictive taking into account the factors set out in 672.54 of the Criminal Code.
Initial Positions of the Parties
- At the commencement of the hearing the parties were requested to provide their initial without prejudice positions with respect to the issues before the Board. Counsel for the Hospital indicated that it was the Hospital’s position that Mr. Korzun continued to represent a significant threat to the safety of the public and that the necessary and appropriate disposition was a continuation of the current detention order with two changes:
The expansion of the geographic area of indirectly supervised passes to the GTA, and
the addition of community living in accommodation approved by the person in charge.
- Both counsel for Mr. Korzun and counsel for the Attorney General supported the Hospital position.
Evidence at the hearing
- The evidence at the hearing consisted of the Hospital Report dated August 11, 2025, and the oral evidence of Dr. Van, Mr. Korzun’s treating physician.
Findings:
- For the Reasons that follow, the Board finds that Mr. Korzun continues to represent a significant threat to the safety of the public and that the necessary and appropriate disposition is a continuation of the current detention order with the changes recommended jointly by the parties.
Index Offence:
- The allegations surrounding the index offence as summarized in the last year’s Reasons for Disposition are as follows :
On Monday March 27, 2023 at approximately 10:00am, the accused attended Royal Bank located at 1881 Steele Avenue West in the City of Toronto. The accused was experiencing issues while attempting to withdraw money from his account with his debit card. As a result, he became upset and started yelling at the witness Zenevich. The victim Evgania Hayak heard the commotion and attempted to assist the accused but became more upset. During the interaction with the victim Evgania Hayak, the accused stated, "I will throw bomb on your branch, I will shoot you with a Kalashnikov and I will rape you".
He further threated to throw a bomb in the bank and raping the victim. The accused subsequently left the bank. At approximately 14:25 the accused returned to the bank and walked to the counter to deposit money. The accused was concealing a 9" blade in his right side waste that was covered by his jacket. The accused spoke with the teller Anthony Garib to deposit the money. During the interaction, the accused removed a black flick knife from his pants pocket and showed it to the teller and said, "I have fought of the police before and I will use it if you call the police". He further pointed the knife from his waste band to the teller during the interaction. Police were contacted and Officers located the accused inside the bank while in possession of both knives.
Background Information Regarding the Accused:
- Mr. Korzun is 56 years of age, divorced with two adult children. His former spouse and children reside in Saskatchewan. Mr. Korzun emigrated to Canada from the Ukraine in about 2007 after graduating from university. He had training as an electrical mechanic, and worked initially in the high-tech sector doing digital program control. In 2011, he sustained a workplace accident and could no longer perform the functions of his employment. In 2013, he obtained employment as a long-haul truck driver and continued in that role until 2022.
Substance Use History
- Mr. Korzun reports that he consumes alcohol around three times a year, only at birthday parties or New Year’s and that he never drank heavily. He also reported that he never used cannabis or any illicit drugs and has no plans to do so in the future.
Legal History:
- Mr. Korzun has no entries on his CIPIC although he reports that he was once charged with making a threat but that the charge was withdrawn.
Psychiatric History
Mr. Korzun’s first admission to hospital with respect to mental health related issues was in December 2011 when he was admitted to hospital in Saskatoon presenting as grandiose and endorsing delusions about winning the lottery and having a business with Bill Gates. Information provided to the Hospital indicated that he had been aggressive towards his wife and children and that they were “scared of him”. He endorsed delusions about his wife being unfaithful, people trying to kill him and had threatened to kill himself. While in hospital he was disruptive and needed to be restrained for his own safety as well as the safety of others. However, after approximately 3 weeks of treatment he successfully appealed his involuntary admission, he left hospital against medical advice. His diagnosis on discharge was Bipolar Disorder Type I – Mania with psychotic features.
In June 2012 Mr. Korzun was again brought to hospital in Saskatoon by police after he was found threatening to assault people at a gas station. On admission he endorsed beliefs about the Mafia and police persecuting him and required mechanical and chemical restraints due to aggression. With treatment he became more settled and showed increased insight.
In 2014 Mr. Korzun was admitted to hospital in Toronto on two occasions after acting out bizarrely and expressing homicidal ideation. With treatment, although his insight and judgement remain poor, he no longer exhibited manic or psychotic symptoms and was discharged with recommendations for community follow-up.
Between 2019 and 2023, Mr. Korzun was admitted to hospital with respect to mental health concerns on five separate occasions generally expressing paranoid delusions. On one of those occasions he had presented at his former employer’s location “agitated and waving a gun around”. His last hospitalization was a few weeks prior to the index offences.
Current Diagnosis
- Mr. Korzun’s current diagnosis is Schizoaffective Disorder, Bipolar Type.
Evidence of Dr. Van
- Dr. Van indicated that:
She had been Mr. Korzun`s treating physician since his transfer to a general unit in April 2025. She had reviewed the Hospital Report and adopted its contents. By way of an update she advised that Mr. Korzun had been the victim of an unprovoked attack by another patient from a secure unit several days prior to the hearing and had suffered serious injuries. He has been interviewed by the police and indicated that he believed the assailant should be charged criminally. Although a CT scan was unremarkable, he is currently being monitored for any possible head injuries. The Hospital will be following up with an assessment of any needs for dental treatment or repair as well as plastic surgery needs.
Mr. Korzun had a documented history of psychotic symptoms including grandiosity and delusions as well as mania and had been the subject of a Community Treatment Order in Saskatoon. He recently changed from oral to injectable medications and the treatment team is still monitoring the impact of the change.
Mr. Korzun has limited insight into his illness and does not accept his diagnosis, but he continues to be adherent to treatment. He is currently at one of the highest privilege levels available to him and there have been no issues with respect to his use of passes. The Hospital is recommending that the boundaries for indirectly supervised passes into the community be expanded to include the greater Toronto area as this would be less ambiguous than the current order and consistent with privileges granted to other patients.
A functional assessment of Mr. Korzun had been completed at the end of March, and it appears that he may require assistance with respect to money management and social interactions. However, she noted that prior to the index offences, Mr. Korzun had lived fairly independently, and that likely independent or semi-supported housing would be appropriate for him. She also noted that a cooking assessment had not yet been performed and would be appropriate.
The risk assessment contained at page 24 of the Hospital report continued to be accurate.
In response to questions from counsel for the Attorney General, Dr. Van indicated that it was likely that Mr. Korzun would continue to be responsive to treatment and that the treatment team needed to commence a search for appropriate housing.
In response to questions from panel members, Dr. Van indicated that Mr. Korzun has limited insight into the index offences and their connection to his mental illness. He continues to believe that he did not threaten anyone. However, he currently displays no active symptoms of his illness.
Final Submissions of the Parties.
- All parties maintained their initial positions at the conclusion of the hearing.
Analysis and Conclusion, significant threat:
- The Board finds that Mr. Korzun continues to represent a significant threat to the safety of the public. He suffers from a major mental illness, schizoaffective disorder- bipolar type, and although he currently displays no active symptoms of his illness, he has a long history of failing to adhere to recommended treatment and acting out aggressively in the community when unwell. He displays limited insight into his illness and the need for medication. Although he is currently adherent to recommended medication, given his limited insight and history of nonadherence, it is likely that absent the supervision of the Board, he would cease taking medication resulting in a recurrence of the psychotic symptoms of his illness and a significant increase in his risk to cause physical and/or psychological harm to members of the public.
Analysis and Conclusion, Necessary and Appropriate Disposition:
- The Board also finds that the evidence supports the joint submission for a continuation of the current detention order. However, given Mr. Korzun`s adherence to medication and lack of symptoms of his illness, the addition of a provision for community living in approved accommodation and the expansion of indirectly supervised community access to include the GTA, are also appropriate. In all the circumstances, it is clear that the Hospital needs the authority to approve accommodation in order to manage risk and meet Mr. Korzun’s needs. Upon discharge into the community, Mr. Korzun will require close supervision to monitor his compliance with treatment as well as any early signs of decompensation. There is no air of reality to consideration of a conditional discharge due to the need for approval of accommodation and his lack of insight as well as history of nonadherence with medication suggest that it is likely he would be uncooperative should the team feel he required hospitalization due to failing to adhere to treatment or the development of early signs of decompensation.
