Decision
1The parties have requested that I provide a direction that incorporates their understanding of the conditions which govern any production provided by the Employer and the Complainant in these proceedings. Accordingly, I hereby direct that any production provided by the Employer and the Complainant in the course of this hearing process be subject to the following conditions:
a. all documents and recordings, electronic or otherwise, are to be kept confidential as among the parties;
b. no copies, electronic or otherwise, are to be made of any document or recording except for the purpose of this complaint;
c. no copies, electronic or otherwise, are to be circulated to third parties, except as necessary for the conduct of the litigation of this complaint, and once that purpose has been completed, any paper copies of documents are to be retrieved from the third parties, and any electronic copies of documents or recordings in the possession of third parties are to be permanently deleted, except such copies, electronic or otherwise, as a professional person is required by law or a professional body to keep as part of their file;
d. the documents and recordings, electronic or otherwise, are to be used for the purposes of these proceedings only and for no other purpose;
e. all paper copies of all documents are to be returned to the provider of the documents at the conclusion of these proceedings and any judicial review proceedings arising out of this complaint, and any electronic copies are to be permanently deleted, save for one copy, electronic or otherwise, to be retained by each counsel in their files; and
f. no personal information contained in any of the documents or recordings, electronic or otherwise, shall be disclosed to any person except for the purposes of this proceeding, except or as required by law.
2For greater clarity, paragraph 1 does not prohibit the use, for any purpose, of evidence that is given or referred to during a hearing at the Public Service Grievance Board or information obtained from such evidence.
