Decision

1Further to the Board’s Interim Direction dated September 9, 2021 and to the Board’s further direction dated September 16, 2021, the Complainant has not provided to the Board, with a copy to Employer counsel, the necessary undertaking with respect to the material offered to be produced by the Employer.

2Therefore, by no later than Monday, October 18, 2021, the Complainant is hereby directed to advise the Board whether he intends to pursue the complaint. Should the Complainant fail to respond within the time allowed, the Board will consider the complaint to have been abandoned and the complaint will be dismissed.

3Should the Complainant confirm an intention to proceed, it will next be necessary to consider any remaining preliminary objections identified by the Employer.
