INTERIM DECISION
1Board Files #P2017-0262 and #P2017-2072 were scheduled for mediation at the Board’s premises for Monday, March 5, 2018 at 10:00am. A Notice of Proceeding to that effect, dated October 30, 2017, was sent to the complainant. On March 5, 2018 representatives for the Employer attended. The complainant was not in attendance. The matter was stood down for a period of time. The Employer then made inquiries and learned that the complainant was at work conducting training. I have no further information as to the reasons for the complainant’s absence from the mediation.
2At 11am and in the absence of the complainant I heard the Employer’s submission. The following direction takes those submissions into account.
3I hereby direct as follows:
(a) This matter is referred to the Registrar of the Board to schedule a new date. The complaints are to be listed for med/arb.
(b) The complainant is hereby directed to provide full written particulars of his complaints. Particulars are defined as the “who, what, when, and where” about which one is complaining. Particulars provide a chronological outline of the events, persons involved, and conduct that are being asserted as the basis for the complaint(s), enabling both the responding party and the Board to understand the basis for, and scope of the complaint(s). Those written particulars are to be provided to the Employer and to the Board by no later than 60 days prior to the next scheduled date.
4Should the complainant not attend at the next scheduled date, the Employer reserves the right to take the position that the complaints should be dismissed at that time.
5This matter is referred to the Registrar for scheduling in accordance with sub-paragraph 3(a) above.
Dated at Toronto, Ontario this 5th day of March, 2018.
