Decision
1This is a discharge case.
2At the first date scheduled for the hearing of this matter, the parties dealt with various issues, including those relating to disclosure and production.
3It appears that there may be documents and other materials currently in the possession of the Greater Sudbury Police Service (“GSPS”), which relate to matters in dispute in this proceeding. Employer counsel is hereby directed to contact the GSPS, and to work with its representative to collect all documents and other materials in its possession that are arguably relevant to the events leading to the Complainant’s discharge. All such documents shall subsequently be disclosed to counsel for the Complainant.
4If it becomes necessary to subpoena these documents, the parties will discuss the issue and advise me of the requirement.
5To be clear, this Order is not a determination of the actual relevance of any documents or other materials that may be obtained from the GSPS.
