HEARING
May 10, 2005.
Decision
David Mitchell, an employee at the Toronto East Detention Centre, filed a grievance with the Board which was set for hearing on May 10, 2005 in Toronto, Ontario. Neither the grievor nor any representative for the grievor appeared at the hearing to represent his interests. I directed the Registrar to contact the grievor by letter. The letter provided as follows:
A hearing was held on May 10, 2005, in respect of your complaint. The Board notes that you failed to appear at this hearing despite your agreement to the date set and being given notice of the proceedings.
Please be advised that the Board will be dismissing your complaint unless you can provide adequate cause as to why this matter should be continued.
If the Board does not receive your written submission by June 10, 2005, your complaint will be dismissed without further consideration.
Since the Board received no response to this letter, and pursuant to the Rules of the Board that the Board may dispose of a case if a grievor fails to appear (Rule 7), Mr. Mitchell’s grievance is hereby dismissed.
