DECISION OF THE TRIBUNAL: May 14, 2026
[1]. This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7 as amended (“the Act”). This application was filed on April 21, 2026.
[2]. In this application, the applicants have requested the Tribunal to review the reasonableness of the evaluation for their Registered Dietician job class. The applicants assert that their educational qualifications were not reasonably evaluated as it requires a master’s degree. The applicant’s challenge the scoring of the educational factor where a master’s degree requirement would score an “F” rating, and a bachelor’s degree requirement scored an “E” rating. The applicants’ assert that their job class cannot be performed with a bachelor’s degree.
[3]. The respondent filed its response on May 5, 2026. In its response, the respondent requested the Tribunal to dismiss this application for failing to disclose a prima facie case. The basis for that request is that the respondent asserts that the Registered Dietician job class does not require a master’s degree and the practicum was considered in the job evaluation.
[4]. No reply was filed within the timeframe set out in rule 43 of the Tribunal’s Rules of Practice.
[5]. The Tribunal directs the applicants to file their submissions, and provide a copy to the respondent at their counsel’s email address listed in the response (this must be identified in the certificate of delivery filed with the submissions), in reply to the respondent’s request for the Tribunal to dismiss this matter for failing to disclose a prima facie case by no later than May 28, 2026.
[6]. The Tribunal notes that it appears that the applicants are self-represented in this matter. The applicant may wish to seek representation in this matter. If the applicant’s do retain representation, they can write to the Tribunal and request an extension to the timelines for filing their submissions directed above.
[7]. If the applicants do not file the submissions directed above, this matter will be dismissed.
