Decision
1This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended ("the Act").
2By letters dated January 9, 2025, the applicant said that its expert witness, Dr. Shillington is "overseas without computer access" on January 29, 2025. The applicant submitted that Dr. Shillington is available for February 3, 5 or 6.
3The panel is not available on those February dates. The Tribunal notes that in its July 15, 2024, decision that cross-examinations would be expected to take place in mid to late January or over the holiday break.
4The Tribunal was not advised that any of the expert witnesses would be out of the country without access to a computer during the timeframe set out in the July 15, 2024 decision, prior to the January 9, 2025 letter.
5The applicant shall have until January 14, 2025 to file any submissions it would like the Tribunal to consider with respect to the issue of Dr. Shillington's unavailability during any of the dates the Tribunal has set for cross examination of expert witnesses.
6The respondent shall have until January 15, 2025 to file any reply submissions it wishes the Tribunal to consider.
