DECISION OF THE TRIBUNAL: January 25, 2024
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7 as amended (“the Act”).
The parties have called their evidence and the only aspect of this hearing left is closing arguments.
By letter dated January 24, 2024, the applicant requested to reschedule the January 26 and 29, 2024 hearing dates due to the unavailability of their advisor. This request was on consent.
Given the circumstances explained, the Tribunal grants the request. The hearing dates scheduled for January 26 and 29, 2024 will be rescheduled to March 1, 2024. Both parties will be expected to make their final arguments on that hearing date.
If the parties are unavailable on March 1, 2024, by no later than February 1, 2024, they are to provide the Tribunal with no less than three of their mutually available dates following the rescheduled January 29, 2024 hearing date. If there are no mutual available dates that are acceptable to the Tribunal, it will reserve its rights to order that closing submissions will be done by written submissions and will set out a submission schedule pursuant to the Rules of Practice.
It is important that this matter be concluded. The events in this hearing go back 23 to 24 years and there have been several delays in resolving these issues between the parties throughout the 24-year history of this case. The applicant in this case is seeking retroactive payments during this entire period.
