Decision
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7 as amended ("the Act").
The parties appeared before the Tribunal on January 15, 2024, for a pre-hearing conference. At that date, the parties requested a second pre-hearing conference for May 27, 2024. That pre-hearing conference was scheduled.
Hearing dates in this matter have been scheduled in September and October 2024.
By letter dated May 24, 2024, the parties requested to reschedule the May 27, 2024 pre-hearing conference, and to extend the timeline for filing witness statements and submissions which were originally due on May 3, 2024 to June 17, 2024. The parties submitted that the reason for the request to reschedule is to permit the parties to engage in settlement discussions.
The Tribunal grants the extension of the witness statements and submissions to June 17, 2024. These witness statements shall be signed by the witness.
The Tribunal hereby cancels the May 27, 2024 hearing date. The Tribunal however will not reschedule the May 27, 2024 pre-hearing date. Any order that a party wishes to seek from a pre-hearing conference, if any, shall be raised in the June 17, 2024 submissions.
Any response submissions to the opposing parties June 17, 2024 submissions shall be filed by July 3, 2024. Any reply submissions will be filed by July 10, 2024.
The Tribunal will consider any submissions filed and issue its decision in due course so that, if the parties are unable to settle this matter, the parties are in the position to start the hearing on the merits on the September 19, 2024 hearing date.
The Tribunal appoints Vice-Chair Sanderson as a mediator to facilitate the settlement discussions and to help ensure any issues are identified and resolved before the September 19, 2024 Tribunal date.
