DECISION OF THE TRIBUNAL: May 2, 2023
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended, (“the Act”).
This application has been adjourned sine die twice to allow the parties to resolve their disclosure issues without requiring the Tribunal’s intervention. Notwithstanding the representations to the Tribunal that these issues are expected to be resolved, they have not been.
The Registrar is directed to set a hearing date for June 19, 2023 on the Zoom platform.
To ensure the parties are prepared for the hearing date, the Tribunal directs:
By no later than May 16, 2023, the applicant will set out its position with respect to what disclosure has not been provided;
By no later than May 23, 2023, the respondent will file any response to the applicant’s submissions; and
By no later than May 30, 2023, the applicant will file any reply submissions.
