DECISION OF THE TRIBUNAL: April 26, 2023
[1]. This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended, (“the Act”).
[2]. Section 4.2 of the Statutory Powers Procedure Act permits a panel of one to issue this procedural/interlocutory decision.
[3]. On April 21, 2023, the Tribunal issued a direction to the parties to provide their availability for a hearing date. The Tribunal provided fourteen dates. The purpose of the hearing date is to consider the request to delay this proceeding indefinitely pending other proceedings.
[4]. On April 25, 2023, the Tribunal received correspondence stating that it does not appear there is mutual availability of any of the 14 dates between the parties and requested dates after July 14, 2023. This is not acceptable to the Tribunal, and it will not further delay a hearing date about whether this proceeding should be delayed.
[5]. Instead, the applicant’s request will be determined in writing pursuant to Rule 67 of the Tribunal’s Rules of Practice.
[6]. By no later than May 5, 2023, the respondent will file its submissions, if any, in response to the applicant’s request of the Tribunal to delay its direction the parties about how they are to use proxy male comparators for the purpose of pay equity maintenance pending other proceedings (1507-11-PE and 3696-10-PE).
[7]. By no later than May 12, 2023, the applicant shall file any submissions in reply that it wishes the Tribunal to consider.
[8]. The Tribunal will consider the parties submissions and issue its decision in due course.
