DECISION OF THE TRIBUNAL: April 21, 2023
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
Section 4.2 of the Statutory Powers Procedure Act permits a panel of one to issue this procedural/interlocutory decision.
On April 20, 2023, the applicant confirmed that the parties have complied with the Board’s directions in its November 23, 2021 decision to the extent it can. The applicant and its union have now both confirmed that they require direction about how to complete the maintenance process using proxy comparators to complete the pay equity plan.
The applicant requests that the direction should wait until the Tribunal’s decision in PEHT File No. 1507-11-PE or 3696-11-PE, where in Participating Nursing Homes, 2021 ONCA 148, the Court of Appeal directed the Tribunal to specify what procedures should be used to ensure that employees have access to male comparators to maintain pay equity.
The Tribunal is not inclined to delay this matter indefinitely. However, this issue will be considered at a hearing date.
By no later than April 28, 2023, the applicant and the union shall confirm to the Tribunal their availability for the following dates:
May 30 and 31, 2023
June 5, 6, 7, 12, 13, 14, 19, 20, 22, 26, 27 and 28, 2023
- The Registrar will set one of these dates for the hearing date subject to its availability. If the Tribunal does not receive availability from the parties, it will set a date pursuant to its availability.
