DECISION OF THE TRIBUNAL: March 8, 2023

Decision

1. This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7 as amended (“the Act”).

2. A hearing date was scheduled for March 8, 2023, to address the respondent’s preliminary objections. Unfortunately, due to a family emergency, the hearing date had to be adjourned.

3. There is a storied history of events leading to this application going back almost two decades. Pre-hearing conferences were held in February and October 2022. At the last pre-hearing conference, the parties agreed to a schedule to provide written submissions with respect to the preliminary issue. The parties also agreed to delay exchanging particulars on the merits until after the determination of the preliminary issue.

4. By March 15, 2023, the parties are directed to consult with one another and confirm with the Tribunal whether they are available to have the March 8, 2023 hearing date rescheduled to one of the following dates in 2023:

March 22, 23, 27, 29

April 13, 21, 25, 26

May 2, 3, 24, 31

June 5, 6, or 7

5. If the parties are not available on any of the dates set out above, the Tribunal will determine the preliminary issue based on their written submissions pursuant to Rule 67 of the Tribunal’s Rules of Practice.
