This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
Section 4.2(1) of the Statutory Powers’ Procedure Act, 1990 permits a single presiding officer to determine this procedural and interlocutory matter.
By letter dated February 22, 2023, the responding party, the Service Employees International Union, Local 1, (“SEIU”) requested the Tribunal to reconsider its decision refusing to grant an adjournment of the February 27, 2023 hearing date. The SEIU submitted that it and the employer are making progress on the pay equity plan and have meetings on February 28, and March 3, 2023 to discuss the next steps for finalizing the plan.
The Tribunal will not reconsider its decision to deny the adjournment request in advance of the February 27, 2023 hearing date. It is not clear to the Tribunal that a resolution between the respondents will resolve the applicant’s stated concern about delay, or affect the arguments on the preliminary objection that the applicant does not have standing to bring this application.
The parties will be entitled to make their request to adjourn during the February 27, 2023 hearing date, but the parties should be prepared to proceed with their argument on the preliminary objection in the event that the adjournment request is not granted.
