This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”). This application was filed on April 14, 2020.
In this application, the applicant requests the Tribunal to take jurisdiction over their complaint because it asserts that the Pay Equity Office has declined to render a determination in this matter.
The Tribunal received correspondence from the Pay Equity Office on September 8, 2022. The Pay Equity Office submitted that it expects to have a decision issued by September 30, 2022.
Given that the Pay Equity Office has represented that it will be rendering a decision in this matter, the Tribunal finds that it is premature to assume jurisdiction at this time.
This application is hereby terminated. This decision is without prejudice to the applicant’s right to file a fresh application if the Review Officer’s decision is not rendered as it has been represented, and is without prejudice to the parties’ rights to request a hearing before the Tribunal after the decision has been issued as per the normal course.
