DECISION OF THE TRIBUNAL: January 31, 2022
[1]. These are applications under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
[2]. Section 4.2(1) of the Statutory Powers Procedure Act, R.S.O. 1990, permits a panel of one to issue this decision.
[3]. By letter dated January 28, 2022 and filed on January 31, 2022, the respondent requested an extension to the production deadline and to reschedule the next hearing date from February 17, 2022 to a date in April 2022. The respondent identifies that the executive director resigned in December 2021, and has not been replaced. The respondent suggested that it would not be able to complete production by the February 17, 2022 hearing date.
[4]. The Tribunal grants the request given the circumstances of this case. However, this will be the only extension regarding production that will be granted. The respondent is directed to produce the requested documents by March 7, 2022.
[5]. The parties are directed to, by no later than February 4, 2022, consult amongst one another and file a list of no less than 5 mutually available dates in April 2022 to reschedule the February 17, 2022 hearing date. The Registrar shall select one of those dates to schedule the next hearing date, subject to the Tribunal’s availability.
