DECISION OF THE TRIBUNAL: April 6, 2022

1. This is an application under the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (“the Act”), in which it was alleged by the applicant union (the “SEIU”) that the respondent nursing homes (“PNH”) had failed to maintain pay equity in respect of the bargaining unit employees subject to pay equity plans concluded pursuant to Part III.2 of the Act (“the Proxy Plans”).

2. By decision dated November 8, 2021, the Tribunal directed the parties to continue establishing their plans and directed the parties to update the status of their progress.

3. The Tribunal received letters dated March 31, 2022 from the SEIU and the PNH about the status of their progress.

4. The SEIU set out the steps that it has taken and submitted that the parties are ready to be provided direction by the Tribunal about how to accomplish proxy pay equity maintenance as directed by the Court of Appeal in Participating Nursing Homes, 2021 ONCA 148.

5. By no later than April 13, 2022, the PHN is directed to file a response to the SEIU’s March 31, 2022 letter.
