DECISION OF THE TRIBUNAL: February 15, 2022
1This is an application filed pursuant to section 24(5) of the Pay Equity Act, R.S.O. 1990, c.P.7 as amended (“the Act”).
2A pre-consultation conference (“PCC”) was held on February 15, 2022. At the outset of the PCC, the Tribunal was apprised that the gender-neutral comparison system (“GNCS”) had not yet been produced to the applicants, notwithstanding the Tribunal’s decision dated December 9, 2021, that stated that these documents were clearly relevant to the issues in dispute.
3By no later than March 8, 2022, the responding party is directed to produce the GNCS, and all documents that were used in the development of the challenged pay equity plan, including but not limited to job descriptions, interview notes, interview forms (if any), job postings, and pay records.
4By no later than March 29, 2022, the applicants shall file with the Tribunal, copying the responding party, a list of where she challenges the pay equity plan in light of the production received.
5The Registrar is directed to schedule second PCC on April 8, 2022, to commence at 9:30 am.
6This panel remains seized of the directions contained in this decision, and the PCC. Otherwise, it is not seized.
