DECISION OF THE TRIBUNAL: August 3, 2021
1. This decision replaces the decision issued August 3, 2021 as it contained a typographical error.
2. This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
3. Section 4.2(1) of the Statutory Powers Procedure Act, R.S.O. 1990, permits a panel of one to determine this issue.
4. This matter has been held in abeyance pending the outcome of the Court of Appeal’s decision in Ontario Nurses’ Association v Participating Nursing Homes, 2021 ONCA 148.
5. The respondent has requested the Tribunal to dismiss this application on a prima facie basis and submitted in support of its request that the applicant’s position cannot be supported given the Court of Appeal’s findings.
6. The applicant shall have until August 24, 2021 to file any submissions it wishes the Tribunal to consider in response to the respondent’s request.
