DECISION OF THE TRIBUNAL: November 18, 2021
These are applications under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
By decision dated September 2, 2021, the parties were directed to attempt to create a job description for both of the applicant’s job classes, and if they were unable to resolve all of the disputes, to identify the differences between them. The parties complied with this direction, although significant disagreements remain.
The parties appeared before the Tribunal on November 16, 2021 to determine the next steps of the process.
The process will be as follows:
a) By March 1, 2022, the respondent will evaluate both the job descriptions as the applicants have described them, and as the respondent has described them, separately using the respondent’s job evaluation tool that was applied for the non-union group. The respondent shall file those with the Tribunal;
b) By April 1, 2022, the applicants shall identify whether there are any outstanding issues that they wish addressed by the Tribunal prior to proceeding to the next step. By April 14, 2022, the respondent shall file any response submissions to any requests made by the applicants. By April 29, 2022, the applicants shall file any reply submissions;
c) By August 2, 2022, the applicants will file signed witness statements for any witness they intend to call in support of any position that they take the respondent’s evaluations incorrectly rated the job descriptions;
d) By September 1, 2022, the respondent will file signed witness statements for any witness they intend to rely upon in response to the applicant’s evidence.
- By December 1, 2021, the parties shall consult with one another any provide the Tribunal with no less than five mutually agreeable dates to schedule the hearing dates in this matter to occur in November 2022. The Registrar shall schedule three dates subject to the panel’s availability.
