DECISION OF THE TRIBUNAL: August 28, 2020
This complaint is filed as a result of a change in the applicant’s employment status in February 2020, followed by a termination of employment in April 2020, both initiated by the respondent. The applicant states that both of these actions were challenged through grievances that have remained unanswered by the respondent. The applicant asks that this matter be dealt with and claims damages.
The applicant does not rely on any provision of the Pay Equity Act, R.S.O. 1990, c. P. 7 (the “Act”), and none of the allegations in the complaint have any apparent connection with the purpose of the Act, as described in section 4 thereof:
4 (1) The purpose of this Act is to redress systemic gender discrimination in compensation for work performed by employees in female job classes.
It appears, therefore, on the face of the complaint itself, that the Tribunal is not the appropriate forum to deal with this complaint.
For these reasons, the Tribunal dismisses the complaint, without prejudice to the applicant’s right to file a new complaint alleging a violation of the Act and including allegations related to pay equity.
