DECISION OF THE TRIBUNAL: July 14, 2020
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
The next hearing date in this application is scheduled for August 13, 2020. We are now one month away, and it does not appear that the Tribunal will be in the position to conduct in-person hearings by that date. I am exercising my discretion to convert this hearing from an in-person hearing to a video hearing that will be conducted using Zoom.
A revised notice of hearing is attached to this decision which contains the Zoom invitation to the video hearing.
Pursuant to my decision dated August 21, 2019, the first issue that the panel will decide is whether the Tribunal has jurisdiction to consider the issues raised in the application. It is this issue that the panel will hear argument about on the August 13, 2020 hearing date, and witnesses are not expected to be present with respect to this preliminary matter.
The parties are directed to electronically file an index of the decisions that they intend to rely upon with respect to the preliminary matter by no later than August 6, 2020. The index of cases must contain proper citations, but copies of the decisions are not required unless there is no citation. It would be ideal if the index can be hyperlinked.
If any party has submissions that they would like the Tribunal to consider with respect to the hearing date scheduled for August 13, 2020, they must file them electronically by no later than July 20, 2020.
