Decision
This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7 as amended (“the Act”). The application filing date is April 14, 2020.
Section 4.2(1) of the Statutory Powers Procedure Act, R.S.O. 1990, permits a panel of one to determine this issue.
The application does not contain a facsimile number or email address for the respondent, The Hamilton Entertainment and Convention Facilities Inc. At this time, because of the limitations created by the current pandemic, the Tribunal is unable to send the Confirmation of Filing because it does not have the ability to send correspondence to this respondent using the traditional “hardcopy” methods of delivery.
Given that the applicant has pled that this respondent has not operated for some time, along with the fact that no fax or email address has been identified in the application, the Tribunal cannot presume that this respondent has a current facsimile number or email address that could be used as an appropriate substitute method of delivery. Furthermore, given that the name of this respondent identifies that it is, or was, in the entertainment and convention facilities business, the Tribunal will not presume that it is operating during this pandemic for obvious reasons.
This application will be processed in the normal course once the Tribunal’s ability to deliver its correspondence by courier resumes.
The timeline for filing responses will be set out in a decision that will accompany the Confirmation of Delivery at a later date.
