This is an application under the Pay Equity Act, R.S.O. 1990, c.P.7, as amended ("the Act").
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
In a decision dated July 25, 2019, the Tribunal granted the responding party employer an extension to August 6, 2019 to file its response. The Tribunal is now in receipt of correspondence from the law firm representing Service Employees International Union, Local 1 ("SEIU") requesting an extension until August 14, 2019 to file its response, as counsel for SEIU is on vacation.
While it would have been preferable that the responding parties filed and delivered their responses to the application in a timely manner, or at least obtained the applicant's consent to the extension, in the circumstances the delay occasioned by the granting of the extension to August 14, 2019 is not unduly lengthy. Accordingly, both responding parties shall have until August 14, 2019 to file and deliver their responses. However, they ought not to anticipate that the Tribunal will grant any further extension beyond that date.
