1This is an application under the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (the “Act”).
2I am issuing this decision pursuant to the authority conferred under section 4.2(1) of the Statutory Powers Procedure Act.
3The Tribunal is in receipt of correspondence dated July 19, 2019 from counsel for the respondent indicating that settlement discussions between the parties have failed and that, accordingly, the matter should be scheduled for a hearing. In addition, counsel seeks an order from the Tribunal requiring the applicants to provide detailed particulars of their complaint, including but not limited to the specific factor ratings with which they disagree, as well as their proposed ratings and their rationale.
4The Registrar is directed to schedule a hearing in this matter.
5With respect to the particulars sought, it appears to me that the application is sufficiently particularized, given the additional allegations that were provided by the applicants in their correspondence of May 11, 2018. I therefore decline to require the applicants to provide further particulars. However, and unless the panel assigned to hear this matter otherwise directs, the applicants ought to expect to present all of their evidence first at the hearing.
