This is an application under subsection 24(6) of the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”).
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
In a decision dated June 14, 2019, the Tribunal stated:
The applicant’s employees affected by the Order appear to be persons entitled by law to be parties, and may wish to participate as such. Accordingly, the applicant is directed forthwith to post a copy of
this decision and the amended application in the workplaces of the applicant in locations where they are likely to come to the attention of the workplace employees. Furthermore, the applicant is to notify the Tribunal in writing regarding the date, time and locations that the decision and amended application were posted, on or before Tuesday, June 18, 2019.
If the PEO or any employee wishes to participate in the hearing of the application they must provide the Tribunal with a Form 2 Response and deliver a copy to the applicant in compliance with the Tribunal’s Rules of Practice, on or before July 3, 2019.
In correspondence dated June 17, 2019, the applicant indicated to the Tribunal that it had posted a copy of the amended application “and decision dated May 29, 2019” at various locations in the workplace. It is not clear what decision the applicant is referring to, but this Tribunal did not issue a decision with that date, nor did it direct the applicant to post such a decision.
As it appears that the applicant did not post the decision dated June 14, 2019, the employees would be unaware of the deadline of July 3, 2019 to file and deliver responses. The applicant is therefore directed immediately to post a copy of the June 14, 2019 decision and this decision, adjacent to one another and to the posted amended application, in all of the locations indicated in the applicant’s correspondence of June 17, 2019. It is then directed to notify the Tribunal in writing regarding the date, time and locations that it posted both decisions of this Tribunal, on or before Monday, July 22, 2019.
If any employee wishes to participate in the hearing of the application they must provide the Tribunal with a Form 2 Response and deliver a copy to the applicant in compliance with the Tribunal’s Rules of Practice, on or before August 6, 2019.
