DECISION OF THE TRIBUNAL: September 27, 2018
Decision
1These are applications under the Pay Equity Act, R.S.O. 1990, c. P.7 as amended (“the Act”) objecting to orders made by a Review Officer (“the Orders”).
2Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
3The Orders issued as a result of an audit performed by the Pay Equity Office (“the Office”). Each Order identifies the Office as the applicant in the matter dealt with by the Office. One relates to a non-union group of employees and one relates to a bargaining unit of employees represented by the Canadian Union of Public Employees (“CUPE”).
4The applicant in the files before the Tribunal is the party against whom the Orders were issued. It has not identified the Office as a responding party to either application. Indeed, in the application related to the non-union group, it has not named any responding party at all.
5By no later than October 4, 2018, the applicant must deliver copies of both applications to the Office, and confirm to the Tribunal in writing that it has done so, and when that occurred.
6By no later than October 4, 2018, the applicant must post a copy of this decision and a copy of its application in respect of the non-union group in conspicuous places in the workplace where they are likely to come to the attention of the affected employees, and confirm to the Tribunal in writing that it has done so, and when that occurred.
7The Tribunal will not process these applications further until the applicant has complied with the above directions.
8The Office and any affected non-union employee shall have until October 19, 2018 to seek to participate in this matter by delivering and filing a response/intervention. In the circumstances, CUPE, which has been served with the application affecting its bargaining unit shall also have until October 19, 2018 in which to file its response.
