DECISION OF THE TRIBUNAL: January 25, 2018

[1]. This is an application under the Pay Equity Act, R.S.O. 1990, c. P.7, as amended (the "Act").

[2]. I am issuing this decision pursuant to the authority conferred under section 4.2(1) of the Statutory Powers Procedure Act.

[3]. The respondent, Brockville General Hospital, seeks to have the Tribunal dismiss this application on a prima facie basis and, in this regard, contends that the facts alleged do not constitute a violation of the Act.

[4]. In the circumstances, the applicants are directed to file written submissions (copied to the respondents) addressing the preliminary issue raised to the effect that the application should be dismissed for failing to disclose a prima facie or arguable case, by no later than February 7, 2018. Should the respondent, Brockville General Hospital, wish to do so, it may respond to the written submissions filed by the applicants (copying the applicants) by no later than February 12, 2018.

[5]. The application is referred to the Registrar to assign a panel for review after February 12, 2018.
