These are applications under the Pay Equity Act, R.S.O. 1990, c. P.7 as amended (“the Act”).
Section 4.2(1) of the Statutory Powers Procedure Act (“SPPA”) permits this procedural decision to be issued by a single-person panel. The SPPA also permits parties to consent to have any matter before the Tribunal decided by a panel of one.
There have been eight days of hearing in this matter before a three-person panel. It is scheduled to continue and conclude on six additional dates in the next four weeks, however, the entire panel cannot be constituted for those hearings. The parties were advised of this, and have elected under the SPPA to continue this hearing before the Deputy Presiding Officer sitting alone.
