DECISION OF THE TRIBUNAL: May 29, 2017
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to issue this decision.
These are applications under the Pay Equity Act, R.S.O. 1990, c. P.7 as amended.
In correspondence dated May 26, 2017, counsel for the respondents in Case No. 0593-16-PE set out a proposal agreed by all the parties in both matters regarding the manner in which the hearings on May 30 and 31, 2017 ought to proceed in light of the recent delivery of a very large quantity of documents by Community Living Toronto (“CLT”). The proposal contemplates that, following opening statements by all the parties, CLT will call its first witness whose testimony in chief is anticipated to take between 1 and 1.5 hearing days. Following the testimony in chief of that witness, the hearing on the merits will adjourn on consent, and the hearing panel will consult with the parties concerning new dates for the resumption of the hearing, as well as deal with any other case management issues that the parties may wish to raise.
The Tribunal is content to proceed in the manner agreed to by the parties.
