DECISION OF THE TRIBUNAL: April 4, 2017
1This is an application under the Pay Equity Act, R.S.O. c. P.7, as amended (“the Act”) which is scheduled for a hearing on April 7, 2017.
2Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to issue this decision.
3The applicant has asked the Tribunal to adjourn the April 7, 2017 hearing date. It advises that it and the Pay Equity Commission have resolved many of the factual and legal issues with respect to the Review Officer’s Order and that there are four outstanding issues which the applicant submits can be dealt with by way of written submissions. It advises that the Pay Equity Commission does not oppose this request.
4Based on the materials that have been filed with the Tribunal, it is not clear that there are sufficient facts upon which to determine the four outstanding issues in this matter in writing. The application is very short, although I note that the Pay Equity Commission did not file a response. Although the applicant has indicated that it has resolved “the factual” issues with the Pay Equity Commission, it has not indicated that the parties have arrived at agreed facts for the purposes of this matter.
5Under the circumstances, the Tribunal declines to adjourn this matter at this time.
