Decision
This is an application filed pursuant to section 24(6) of the Pay Equity Act, R.S.O. 1990, c.P.7, as amended (“the Act”). This matter is scheduled for hearing on July 12, 2016 and July 13, 2016. As described in previous decisions of the Tribunal, the applicant in this matter has filed a prima facie motion asserting that the Review Officer’s findings taken together with the responding party employee’s pleadings, do not raise a prima facie violation of the Act.
The Tribunal has considered the parties’ submissions respecting the applicant’s motion and declines to dispose of this matter on a prima facie basis. The matter shall proceed to be heard on the merits on July 12, 2016 and July 13, 2016 as scheduled. If requested, full reasons respecting the instant motion will be included in the decision on the merits.
