DECISION OF THE TRIBUNAL: July 11, 2016
These are applications under the Pay Equity Act (“the Act”) filed by individuals who previously filed notices of objection to a pay equity plan ordered by a Review Officer. In each case, the Pay Equity Office (“the Office”) notified the Tribunal that a notice of objection had been received, and the Tribunal advised each individual objector that she must deliver and file her completed application by a specified date if she wished to pursue her objection, failing which it would be deemed to have been abandoned.
There appears to be an issue, raised by counsel for the responding party, as to whether two of the objecting employees complied with the timelines, or missed them by one day. Given all of the objections relate to the same plan, and the one that was undoubtedly filed in a timely manner raises some issues related to the plan as a whole, I am prepared to treat all three applications as having been commenced in a timely fashion.
Further, given that there are common features among the objections, it makes sense that they be listed together for hearing and pre-hearing, and that the responding party be permitted to file a single response addressing all three objections.
The responding party has requested an extension of time until July 29, 2016 to file its response. Notwithstanding this extension is not consented to, I find it is appropriate to grant it, as it is of relatively short duration, and will cause no appreciable delay in the processing of these matters.
These matters are referred to the Registrar to schedule for a Pre-Hearing Conference on or after August 15, 2016.
This is a decision that section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to make.
