DECISION OF THE TRIBUNAL: June 20, 2016
This is an application filed pursuant to section 24(6) of the Pay Equity Act, R.S.O. 1990, c.P.7, as amended ("the Act"). This matter is scheduled for hearing on July 12, 2016 and July 13, 2016.
Section 4.2(1) of the Statutory Powers Procedure Act permits a panel of one to decide this matter.
During a case management hearing, the parties agreed to a timeline within which the applicant could file submissions respecting preliminary matters, if any, in advance of the hearing. They also agreed on a timeline for circulating an Agreed Statement of Facts.
The Tribunal notes that the timeline for the applicant to file submissions respecting preliminary matters has now elapsed. As such, the Tribunal expects the parties to be prepared to proceed on the merits of this matter on July 12, 2016.
Based on correspondence that has been filed with the Tribunal, it appears that a draft Agreed Statement of Facts has been circulated. However, there has been no confirmation that same has been finalized. The Tribunal trusts that the Agreed Statement of Facts will be finalized in advance of the July 12, 2016 hearing date so that this matter can proceed on the merits at that time. If that is not the case, the parties are to notify the Tribunal forthwith.
The Tribunal notes that the parties have exchanged correspondence respecting the production of documents. There has been no request for the Tribunal to issue any orders in this regard to date. If any outstanding production issues remain between the parties at this time, the parties are to notify the Tribunal forthwith but no later than June 24, 2016.
